Kolkata Rape Case: Should We Grant Bail? The absence of the CBI lawyer in the court angered the judge

Across West Bengal, there has been an uproar with demands for justice in the rape-murder case of a trainee doctor at the RG Kar Medical College and Hospital. Protests are happening almost every day in the state. The only arrest so far in the case is that of civic volunteer Sanjay Roy, who was nabbed by the Kolkata Police. The CBI later took him into custody, but a Sealdah court judge expressed anger at the behavior of the investigating agency, the CBI. Let us tell you that on August 9, a trainee doctor was raped and killed. The CBI is investigating the case.

CBI lawyers were not present in the court during the hearing on the expiry of the custody of accused Sanjay Roy in the Kolkata rape case on Friday. After this, the judge warned the investigating agency and said that he would grant bail.

Kavita Sarkar, the lawyer of the arrested accused Sanjay Roy, claimed in the court that the arrested person was not involved in the incident. Even in the High Court, there is no pending bail case of the accused. Further, he is a permanent resident of Kolkata and not an outsider. On this argument, he appealed for bail to the accused.

On this day, lawyer Kavita Sarkar applied for the accused’s bail and said, “There has been no progress in the investigation. That is why I am seeking bail. The judge asked again, “Who is from the CBI?” At the same time the Assistant Investigating Officer of CBI stood up. The judge asked, ‘Where is the CBI public prosecutor?’

The lady officer told the court room that the lawyer was on his way. After this the judge expressed his displeasure. “This is gross negligence on the part of the CBI,” the judge said. Judge Pamela Gupta remarked that day, “At 4:30 p.m., the public prosecutors are still on their way! What should I do for bail? This is very unfortunate.

Shortly after the court expressed displeasure, lawyers from the CBI’s legal cell reached the Sealdah court. He reached there and applied for 14 days jail custody. The court accepted it. This means that the arrested person will remain in jail custody for the time being.

TMC has questioned the role of CBI

But questions are being raised in various circles that why is the central investigation agency’s careless attitude in such an important event? The Trinamool Congress, the ruling party in the state, targeted the CBI. From state ministers Bratya Basu and Shashi Panja to Trinamool MP Sayani Ghosh, everyone has questioned the professionalism of the investigating agency. Bratya Basu said, ‘Where was the CBI on the day of the important hearing of the RG tax case? Where were his lawyers? If BJP’s favorite CBI has this role, how will they deliver justice?

TMC spokesperson Kunal Ghosh said that before the Lok Sabha elections, the CBI was working as per the instructions of the CBI. Now how can BJP say that we cannot control CBI. BJP has to take responsibility of CBI. We are shocked by the CBI’s action in the court in this case.

On the other hand, BJP termed this step of CBI as irresponsible and said that we are not the spokesperson of CBI. Like others, we also have a question to the CBI that why the CBI did not come yesterday when Sanjay was produced in the court? BJP MP Samik Bhattacharya said that the CBI’s move is unfortunate and unexpected.
