Taking cognizance of the case of an uncle marrying his niece, the Delhi High Court has issued a notice to the Arya Samaj Mandir. The court said that the temple should also ensure that the witnesses to the marriage are genuine or not. Also, the temple should try to have at least one witness from both sides.

Uncle was married

It is alleged that an uncle, though already married, declared himself unmarried and married his niece in an Arya Samaj temple. When the family came to know about this, there was an uproar. After this it was discovered that the uncle was already married and the witness he had produced at the time of his niece’s marriage was also fake. Taking note of this matter, Justice Pratibha M. A bench of Singh and Justice Amit Sharma said the temple would try to have at least one witness from both sides, who could be a relative or an acquaintance who has known them for a long time. time

During the hearing of the case, the court said that the manner in which the girl’s uncle lied in front of the Arya Samaj temple and declared himself unmarried was clearly illegal and the marriage was also invalid. The court said that except for the married couple and the priest, no one was present at the wedding ceremony held at the Arya Samaj temple in Malviya Nagar. The court said that the validity and sanctity of this marriage is completely doubtful. In fact, the Arya Samaj Mandir takes affidavits from the parties regarding marital status, but does not carry out further verification.

What did the court say?

The court said that the Arya Samaj Mandir should now ensure that when witnesses are produced for the purpose of marriage, they are genuine and authentic witnesses, whose status can be properly verified. The temple should try to call at least one witness from both the parties i.e. the bride and groom who should be relatives and if there is no relative then a long time acquaintance of the parties will be allowed to be the witness. Currently the court has annulled this marriage.
