In Bareilly, Uttar Pradesh, the court has given a big decision. In which the special judge of the fast track court Ravi Kumar Diwakar has acquitted the accused who raped the mother of three children. While the complainant has been found guilty of arresting the woman accused and has been fined ₹1000. Not only this, the court also ordered the SSP to investigate and take action against the police station in-charge and CO. After the court’s order, the police department is in a commotion.

In fact, in 2019, a woman filed a complaint at the Prem Nagar police station in Bareilly, Uttar Pradesh. The woman said that she met Shivam Sharma at Lala Market 3 years ago. After the meeting, Shivam started coming to the woman’s house and Shivam used to force his way into the house in the absence of her husband.

Alleged exploitation of woman for 3 years

According to the woman’s complaint, Shivam had declared himself unmarried and had physical relations with her on the pretext of marriage. He drove her away from home and kept her as his wife in rented houses in Moradabad, Ghaziabad and Bareilly. Not only this, he used to beat her and threaten to defame her if she did not have physical relations. He was saying that he has some porn videos which he will make viral. This sequence lasted for three years and he exploited it for three years. The police registered a report in the entire matter and after investigation filed a charge sheet in the court and the public prosecutor produced five witnesses.

After which Special Judge Fast Track Court Ravi Kumar Diwakar acquitted the accused Shivam Sharma during the hearing. The woman who filed the report was found guilty and fined ₹1000. Not only this, the special judge has directed the SSP to take action against the investigating police station head.

What did the fast track court judge say?

In the entire case, Special Judge Fast Track Court Ravi Kumar Diwakar says that an impartial investigation is a fundamental right of not only the plaintiff but also the accused in the case. It is the entire responsibility of the court to protect the rights of the plaintiff and the accused. If there is abuse of power by the prosecutor or the police and the accused is implicated in a false case, the prosecution and the police should definitely be punished. In the impugned case, the police have certainly abused their powers by filing a false and baseless charge sheet.
