‘Wives grab money even after punishment’, High Court’s important comment on divorce

Punjab and Haryana High Court has said a big thing about divorce. The court said that even after the husband is convicted in a matrimonial matter, the wife demands maintenance from him, which is very unfortunate. In fact, the High Court said this when a husband was filing a divorce petition against his wife.

A bench of Justice Sureshwar Thakur and Justice Sudipti Sharma said that in matrimonial matters, it has been observed that many times wives take advantage of their husbands. Tries to extort money from them. An appeal is filed by either the husband or the wife and this happens when the husband and his family are convicted on his complaint.

The High Court has made this important comment

Referring to a case, the court said that on the basis of an FIR of a wife, her husband and entire family were jailed, even though she complained and demanded maintenance from her husband. This is not correct. The court said that the time has come that such demands should stop in the society. Lower courts should also look into all aspects in such cases.

The court further said that justice demands that while dealing with matrimonial matters and awarding permanent maintenance, every aspect of the case should be considered, including the conduct, conduct and level of allegations made by all the parties. In fact, the court was hearing an appeal against an order of a family court, which dismissed the husband’s petition for divorce on the ground of cruelty under Section 13(1)(ia) of the Hindu Marriage Act.
