Bihar Chief Minister Nitish Kumar has received a big shock. In Bihar, the Nitish Kumar government had increased the reservation limit from 50 percent to 65 percent. The court has canceled this decision of the state government. This has given a big shock to the Nitish Kumar government. In Maharashtra too, after Maratha reservation, the demand for increasing the reservation limit had started gaining momentum. Therefore, Maharashtra may also have to face tension due to this decision of the court.

This decision was given by the bench of the Chief Justice of Patna High Court. The Bihar government had decided to give 65 percent reservation to SC, ST, EBC and OBC in educational institutions and government jobs. This reservation was challenged in the court. While hearing these petitions, the court has taken this important decision. These petitions were filed by petitioner Gaurav Kumar and others. After hearing on this, the decision was reserved on March 11. Its decision has been given today.

What percentage of jobs are there in

Last year, the financial and educational figures of the state were presented in the Bihar Assembly. The government also gave information about the share of each person in state government jobs. The population of the open category in Bihar is 15 percent. But their number is the highest in government jobs. A total of 6 lakh 41 thousand 281 people of the open category are in government jobs. OBC category is in second place with 63 percent population. Only 6 lakh 21 thousand 481 people of OBC are in government jobs. Scheduled caste people are in third place. The population of Scheduled Caste is 19 percent. Only 2 lakh 91 thousand 4 people of SC are in government jobs. The share of ST in the state’s population is only one percent. That is, 1.68 percent. Only 30 thousand 164 people of this category are in government jobs.

Current status of reservation

At present, there is 49.5 percent reservation in the country. There is 27 percent reservation for OBC. While 15 percent reservation is given to SC and 7.5 percent to ST. Apart from this, 10 percent reservation is given to people of economically backward general category. So the reservation limit has already gone above 50 percent. However, in November 2022, the Supreme Court upheld the decision to give reservation to the economically backward general category. The court said that this quota does not harm the basic structure of the Constitution.

Tension for Maharashtra?

OBC, Maratha and Dhangar communities in the state have demanded reservation. A hunger strike is going on for that. OBCs have taken a stand that they should not give reservation to others from their quota. Therefore, the demand for separate reservation for the Maratha community has started gaining momentum. If the Maratha community is given separate reservation, the limit of 50 percent reservation will be exceeded. The decision given by the Patna court has increased tension in Maharashtra, so much so that there is a discussion that if it is challenged in court, the reservation will not stand. Should the reservation limit be increased or not? It is being said that now such confusion is likely to arise.
