The Bihar government has approached the Supreme Court challenging the decision of the Patna High Court. The Bihar government had increased the reservation quota for disadvantaged sections in government jobs and educational institutions in November last year following a caste-based survey report. But later the Patna High Court canceled it. In this, reservation for Backward and Very Backward Classes (SC/ST) in public employment and admission to educational institutions has been increased from 50 per cent to 65 per cent.

The Bihar government has filed a petition in the Supreme Court through its lawyer Manish Singh. The state government has sought an interim stay on the High Court’s decision, saying that if interim relief is not granted, a large number of recruitment processes are going on in the state, some of which are in advanced stages. This will affect the selection process. The petition said that the High Court’s finding of adequate representation of backward classes was based on the caste survey statistics. This is a violation of the state’s conscience.

The decision came on June 20

A bench of Chief Justice K Vinod Chandran and Justice Harish Kumar of the Patna High Court, in a judgment delivered on June 20, said that the reservation of educational institutions for Scheduled Castes, Scheduled Tribes and Other Backward Classes and in admission to posts and services in Bihar is outside the ambit of the reservation constitution. After this, this decision of the Bihar government was canceled in the Patna High Court. The court also said that if there is a need to increase the limit of reservation then the constitution bench will decide.
