Mamata Banerjee’s government will introduce a bill in the assembly to provide separate death penalty for rapists in West Bengal. Mamata Banerjee’s government has got Cabinet approval for this bill. The bill will be passed in a two-day special session of the West Bengal Legislative Assembly and later sent to the Governor for assent. A huge controversy has arisen on this issue and politics has also started.
After the rape and murder case at Kolkata’s RG Kar Hospital, on 28 August, Mamata Banerjee announced that a two-day special session of the Legislative Assembly would be convened, where the state government would pass an anti-rape law on death penalty. The rape session is starting from 2nd September. The bill will be introduced during the two-day session.
Why is Mamata introducing the anti-rape bill?
- The main objective of passing this law is to speed up the process of action and decision making.
- Mamata Banerjee and her government want to hang the accused rapist within 10 days.
- Mamata wants the case to be tried within 10 days of the crime or the person is found guilty.
- The draft bill has been approved in the cabinet meeting of the West Bengal government.
- The Bill will be passed in the special session of the Legislative Assembly on September 2 and 3.
What is in the draft anti-rape bill?
- Rape or rape and murder cases should be tried in fast track courts.
- Immediate medical examination of rape victim.
- Immediate death sentence on conviction.
- The State has a separate right to impose the death penalty.
- The Center should also convert the trial of rape and murder cases into a fast track process.
Uproar over anti-rape bill
According to Calcutta High Court Senior Advocate Arunabh Ghosh, there is no provision for the state government to enact a law on death penalty in the state. This can only be done by Lok Sabha and Rajya Sabha, which again can be overruled by the Supreme Court, whatever Mamata Banerjee is doing is only for politics. This bill has no recognition and decision-making power. This bill has no future except for political gain.
