Mamata may comment on Governor… Calcutta High Court notice – avoid defamation case

Four Trinamool leaders, including West Bengal Chief Minister Mamata Banerjee, may comment on the Governor. A division bench of the Calcutta High Court passed such an order in a defamation case filed by the Governor. The court also said that care should be taken while commenting that it does not violate the definition of defamation or the law relating to defamation. A division bench of Justice Indraprasanna Mukherjee passed this order on Friday. After which the division bench returned the case to the single bench of Justice Krishna Rao.

Let us tell you that initially this case was going on in a single bench. Justice Krishna Rao ordered that a total of four Trinamool leaders, including the Chief Minister, cannot make any derogatory remarks against the Governor till August 14. He gave interim directions in this regard.

Chief Minister Mamata Banerjee, MLA Sayantika Banerjee, MLA Rayat Hussain and Trinamool leader Kunal Ghosh approached the division bench challenging the order. The petition said that the order was interfering with Mamata Banerjee’s freedom of speech.

While hearing the petition, the division bench said that human dignity is a very sensitive and sacred matter. Instruments are available in law to protect it. It has also been said that people’s freedom of expression cannot be curtailed. However, this freedom of expression has some limitations. Everyone has the right to know the truth. However, the Chief Minister or higher officials have to be more responsible in exposing this truth.

A few days ago, Mamata Banerjee said that she was getting complaints from women in Nabanna. Women say they are afraid to go to Raj Bhavan. After this Governor CV Anand Bose filed a defamation case. Sayantika, Kunal and Rayat Hussain were also made parties in that case.

The single bench banned the statement

The case was heard on July 16 in Justice Krishna Rao’s court. The Single Bench found that as claimed by the petitioner, many of the comments defamed him. Such comments should be avoided. The court said that till August 14, the Chief Minister should refrain from making any remarks defaming the Governor. A suit was filed in the Division Bench challenging the interim order of the Single Bench. Advocate Saumendranath Mukherjee is fighting the case on behalf of the Chief Minister.

The Chief Minister’s lawyer said that the Chief Minister has made this comment in public interest. In a defamation case filed by the Governor, a single bench passed an interim order without any evidence in favor of the allegations. He also said that none of the Chief Minister’s comments addressed to the Governor were offensive. Accused Sayantika, Rayat, Kunal Ghosh also made similar claims in this case. Currently, the Division Bench referred the case back to the Single Bench.
