Innocents’ blood was shed, now they pleaded for mercy, the President rejected the petition

The Old Red Fort was attacked 24 years ago. On 22 December 2000, terrorists opened fire on a contingent of 7 Rajputana Rifles deployed in the Red Fort complex. Three army personnel were martyred in this attack. Four days after the attack, Delhi Police arrested Pakistani citizen and member of the banned Lashkar-e-Taiba (LET) Mohammad Arif alias Ashfaq. Arif was found guilty of conspiring with other terrorists. In October 2005, a subordinate court sentenced him to death. In subsequent appeals, the Delhi High Court and the Supreme Court upheld this decision. After this decision of the court, the accused Arif had appealed to the President for mercy.

The Supreme Court had upheld Arif’s death sentence, calling the attack on the Red Fort a direct threat to the unity, integrity and sovereignty of the country. Arif had filed a review petition. However, the Supreme Court rejected his petition on November 3, 2022 and upheld the death sentence given to him. The Supreme Court had said that there is no evidence on behalf of Arif that reduces the severity of his crime.

After the Supreme Court’s decision, Arif filed a mercy petition in the President’s Office. Arif’s mercy petition was received by the President’s Office on May 15. President Draupadi Murmu took a decision on this and rejected the mercy petition of Pakistani terrorist Mohammad Arif alias Ashfaq on May 27. Officials of the President’s Secretariat have given this information citing an order of May 29.

The appellant accused Mohammad Arif alias Ashfaq in the 2022 order of the Supreme Court was a Pakistani citizen. He is said to have entered Indian territory illegally. After studying the Supreme Court’s decision and the evidence presented by the police, President Murmu rejected Arif’s mercy petition. This is the second mercy petition rejected by President Murmu after assuming office on July 25, 2022.
