High Court upset over bulldozer action, seeks reply from Yogi government

After the Supreme Court, now the Allahabad High Court has questioned the action of bulldozers in Uttar Pradesh. A single bench of Justice Prakash Padia has raised questions while hearing this case. While hearing a case in Uttar Pradesh’s Azamgarh district, the Allahabad High Court expressed displeasure and asked the Uttar Pradesh government what were the circumstances that led to the demolition of the petitioner’s house without following due process of law.

The court has asked the UP government to file a reply in this matter. Now the High Court will hear this case again on September 18. Sunil Kumar of Azamgarh had petitioned the High Court, in a land dispute case, where the Additional Collector of Azamgarh ordered the demolition of his house on July 22 without hearing Sunil’s plea. After this the administration demolished his house with bulldozers. Sunil alleges that his house was hastily bulldozed without giving him a chance to be heard.

Supreme Court Commentary

A few days ago, during the hearing of a case, the Supreme Court said that even if a person is found guilty, his house cannot be demolished. This comment was made by a bench of Justices Hrishikesh Rai, Sudhanshu Dhulia and SVN Bhati in a Gujarat case.

On September 2, the court also made such remarks while hearing a plea by Jamiat Ulma-e-Hind, which complained of bulldozers running on the houses of the accused in various parts of the country without following the law. A process on which a bench of Justices BR Gavi and KV Viswanathan said it would lay down guidelines for the entire country.
