High Court upholds ban on five separatist groups in Jammu and Kashmir, ban imposed by Home Ministry

The tribunal upheld the ban imposed on five separatist groups in Jammu and Kashmir. On this, the High Court said that these groups are threatening the integrity of India by inflaming separatist sentiments. These include the four factions of the Muslim Conference Jammu and Kashmir (Bhat faction) and the Jammu and Kashmir People’s League (JKPL).

On February 28 this year, the Union Home Ministry issued a notification declaring the Muslim Conference Jammu and Kashmir (MCJK-Bhat) a banned organisation. After this, on March 18, the ministry constituted a judicial division, i.e. a special court, which was constituted for the purpose of deciding the matter. So that it can be examined whether there is sufficient evidence to declare MCJK-Bhat an illegal organization or not. Delhi High Court Judge Neena Bansal Krishna was entrusted with the responsibility of taking a decision in this regard.

The ban remained intact

A court headed by Justice Krishna issued two separate orders upholding the ban imposed under the Unlawful Activities (Prevention) Act (UAPA). One of these orders pertains to Muslim Conference Jammu and Kashmir (Bhat group) while the other pertains to four groups of JKPL.

In a notification issued on Tuesday, the ministry said a special court, exercising special powers under the Unlawful Activities (Prevention) Act, 1967, passed an order on August 23 confirming the declaration made in the notification.

Relations with terrorist organizations

While imposing the ban, the ministry said that MCJK-Bhat has links with banned terrorist organizations and supports terrorism in Jammu and Kashmir. Its members are engaged in creating hatred and resentment against India for secession of Jammu and Kashmir from the Union of India.

Allegation of illegal activities

The ministry said its leaders and members are involved in raising funds through various sources, including Pakistan and its shell outfits, to support terrorist activities and carry out illegal activities, including frequent stone pelting on security forces. The MCJK-S has consistently asked the people of Kashmir to refrain from participating in the elections thereby targeting and disrupting the constitutionally recognized fundamental principles of Indian democracy.

The Special Court has banned four factions of the Jammu and Kashmir People’s League – JKPL (Mukhtar Ahmed Waza), JKPL (Bashir Ahmed Tota), JKPL (Ghulam Mohammad Khan alias Sopori) and JKPL (Aziz Sheikh) led by Yakub Sheikh have been confirmed. .
