A shocking case has come to light from Agra. A Babu stationed in the District Court obtained bail for the accused in jail by creating fake bail papers. When the victim came to know about this, he filed a complaint in the court. The clerk of court was found guilty in the investigation. He was suspended. Hearing this case, the court sentenced five people including the accused Babu to five years imprisonment and a fine of 20 thousand rupees.
According to the case registered at New Agra Police Station, the victim alleged that her relatives Uncle Ashok, Aunt Meera Devi, Lavkesh and his wife Asha Devi, Phool Singh, residents of Pathauli, Shahganj Police Station, Agra, wanted to take possession by force. For which he beat the victim’s mother and caused serious injuries to her. In 2004, a case was filed against him on charges of assault, causing injury with a sharp weapon, uttering obscenities and threatening to kill.
Bail was obtained by forging bail papers
When there was apprehension of punishment based on witness evidence in the case, his uncle and aunt met the office clerk Pawan Aggarwal and got fake bail papers prepared. When the victim came to know about the acquittal of the accused, she investigated the court. He came to know that no such order was given by the court. The victim complained to the District Judge. A three-tier inquiry found the bail order to be completely bogus. The then Magistrate Steno categorically refused to pass and type any such order. Clerk Pawan Aggarwal’s involvement in the case came to light but was dismissed by the District Judge.
Case against Babu
Ashok and Meera Devi, the accused in this case, were highly educated and working in government jobs in Bharatpur. On behalf of the prosecution, Braj Mohan, son of plaintiff Su Kushal Singh, Steno Anil Kumar, Additional Superintendent of Police Rajendra Prasad, DSP Shyam Kant, Additional Superintendent of Police Namrata Singh, CO Chaman Singh Chavda were produced in the court for testimony.
Five years imprisonment, 20 thousand fine
After hearing the case, ACJM-2 Bateswar Kumar convicted all the accused and sentenced them to five years imprisonment and a fine of Rs 20,000. While passing the order against the sacked clerk Pawan Kumar, the court said there has been abuse of judicial process by the accused. The offense committed by the accused amounts to interference with the administration of justice and serious attack on the very essence of judicial process. The court said that the accused Pawan Kumar was a public servant and he deliberately conspired with the accused to subvert the administration of justice.
