Accused gets bail in Gurugram accident case
You may remember the Porsche car incident in Pune where a minor boy killed a boy and a girl in a high speed Porsche car. Both died in this accident. The accused was a minor, so he was taken to the Juvenile Court, where the court sentenced him to write an essay on road safety and granted him bail. A similar case has now come to light in the Gurugram road accident where a person driving an SUV from the wrong side was arrested by the police but later released on bail. However, the police have said that the accused driver may be re-arrested if the investigation reveals necessary and serious charges.
Bike rider Akshat Garg and his friend Pradyuman were going as usual in Gurugram on Sunday morning. His group of friends go to Ambiance Mall every Sunday where after tea-breakfast they decide where they want to go. Akshat and Pradyuman were going under the same plan on Sunday too but they collided with a speeding SUV coming from the front. The SUV coming from the wrong side and Akshat collided so terribly that Akshat died on the spot.
The police arrested him from the spot
Pradyuman stopped the car driver and by then the locals had also gathered. The entire matter was immediately reported to the police. The police reached the spot and conducted an investigation. Police arrested Kuldeep Kumar who was driving the XUV 3XO. Even after being caught by the police, the accused did not even show his driving license. After this, the accused got bail and is currently out of police custody.
All evidence, still public
Akshat’s friend Pradyuman’s GoPro camera was also on at the time of the accident. In which the video of the accident was also recorded, the police have also collected that video as evidence. It can be clearly seen in the video that as soon as Akshat turns his bike, he has a horrific collision with a car coming from the wrong side. Parts of the bike were blown off in the collision and parts of the bike and car were seen flying several feet high. The bike also caught fire after the collision.
Cases under which sections
Accused Kuldeep Kumar is a resident of Ghitorani in Delhi and was going somewhere. In haste, he took the car on the wrong side. Traffic rules were thoroughly ignored. If this had not happened, even Akshat would be among us today. Police have registered a case against accused Kuldeep under sections 106 (causing death by negligence), 281 (negligent driving), 324 (4) causing damage by accident, 166 (compensation after motor accident). The police have not registered a case of culpable homicide not murder against Kuldeep.
Why was the crime of murder not registered?
Advocate Kapil Sankhla of the Supreme Court has said that, in any case, murder is considered murder only when there is an intention to kill. SUV driver Kuldeep and deceased Akshat never met each other. The police said that now the accused has got bail. The case is being investigated. Strict scrutiny is being done on all aspects.
