Allahabad: Don’t impose onerous conditions while granting bail, advises District Courts of High Court.

The Allahabad High Court has advised the district courts not to impose arbitrary bail conditions that would hinder release from jail. The court said that it is the responsibility of the trial court to consider the socio-economic status of the accused while deciding the bail to release the accused on bail.

The High Court held that the conditions should not be such that if they are not complied with, the purpose of granting bail would be defeated. The court says that people who are poor or belong to the marginalized sections of the society cannot comply with such bail conditions due to which they cannot be released.

‘The socio-economic status of the accused should be taken into account’

While hearing the plea of ​​Arman of Agra, Justice Ajay Bhanot said that it is the responsibility of the trial court to consider the socio-economic status of the accused while deciding the bail. The court made this comment while granting bail to Arman of Agra, who has been in jail since September 13, 2020. Armaan has been booked under the UP Gangster Act at Etmadpur police station in Agra. He had approached the High Court seeking bail as the trial court had rejected his bail plea in one of the many cases registered against him.

The court also directed the Agra District Legal Services Authority (DLSA) to ensure that proper legal assistance is provided to the petitioner to deposit the security amount and complete other formalities for release on bail.
